A hazardous condition shall be corrected immediately or the area shall remain posted until the hazardous condition is corrected. If the condition creates an imminent danger, everyone except those persons referred to in section 104(c) of the Act shall be withdrawn from the area affected to a safe area until the hazardous condition is corrected. Only persons designated by the operator to correct or evaluate the hazardous condition may enter the posted area. Any violation of a mandatory health or safety standard found during a preshift, supplemental, on-shift, or weekly examination shall be corrected.\n\n(b) A record shall be made of any hazardous condition and any violation of the nine mandatory health or safety standards found by the mine examiner. This record shall be kept in a book maintained for this purpose on the surface at the mine. The record shall be made by the completion of the shift on which the hazardous condition or violation of the nine mandatory health or safety standards is found and shall include the nature and location of the hazardous condition or violation and the corrective action taken. This record shall not be required for shifts when no hazardous conditions or violations of the nine mandatory health or safety standards are found.\n\n(c) The record shall be made by the certified person who conducted the examination or a person designated by the operator. If made by a person other than the certified person, the certified person shall verify the record by initials and date by or at the end of the shift for which the examination was made. Records shall be countersigned by the mine foreman or equivalent mine official by the end of the mine foreman's or equivalent mine official's next regularly scheduled working shift. The record shall be made in a secure book that is not susceptible to alteration or electronically in a computer system so as to be secure and not susceptible to alteration.\n\n(d) Retention period. and\n\n(ii) All equipment originally furnished with or retrofitted with automatic emergency-parking brakes which meet the requirements of this section.\n\n(2) On and after May 23, 1991, all other equipment.\n\n(b) Automatic emergency-parking brakes shall—\n\n(1) Be activated immediately by the emergency deenergization device required by 30 CFR 75.523-1 and 75.523-2;\n\n(2) Engage automatically within 5.0 seconds when the equipment is deenergized;\n\n(3) Safely bring the equipment when fully loaded to a complete stop on the maximum grade on which it is operated;\n\n(4) Hold the equipment stationary despite any contraction of brake parts, exhaustion of any non-mechanical source of energy, or leakage; and\n\n(5) Release only by a manual control that does not operate any other equipment function.\n\n(c) Automatic emergency-parking brakes shall include a means in the equipment operator's compartment to—\n\n(1) Apply the brakes manually without deenergizing the equipment; and\n\n(2) Release and reengage the brakes without energizing the equipment.\n\n(d) On and after November 24, 1989, rubber-tired, self-propelled electric face equipment not covered by paragraph (a) of this section shall be equipped with a means incorporated on the equipment and operable from each tramming station to hold the equipment stationary—\n\n(1) On the maximum grade on which it is operated;
